- We are committed to processes that are respectful of the privacy of all donors. This policy explains how we use information we collect or receive about individuals and how they can limit the use of such information. We are registered with the Information Commissioner in the UK.

1. Definitions
- “Authorised user” a person or organisation who has agreed to use the website subject to the terms of this agreement.
- “eBay for Charity” the programme operated by MissionFish and eBay, enabling eBay users to support charities through the eBay websites.
- "Necessary Communication" a communication which is necessary to our operations.
- "Necessary Disclosure" a disclosure of your Personal Information that is necessary to our operations.
- "New Uses" any use of Personal Information which is different from the purposes outlined in this Policy.
- "Non Personal Data" any data that is not personal data.
- "Optional Communication" a communication which is not a Necessary Communication.
- "Optional Disclosure" a disclosure of your Personal Information which is not a Necessary Disclosure.
- "Personal Information" the information about you which allows you to be identified as a living person.

2. Information Gathered
- We collect two types of information from you:
- 2.1 information our website gathers automatically, and
- 2.2 information we receive from eBay through the eBay for Charity programme
- Like many other websites we may use standard technology known as "cookies" to collect information about your use of the Website. We do not use "cookies" to detect any personal information that you have not supplied to us. We use this technology to provide you with a more convenient experience when using our website. For example, we use "cookies" to remember details which assist with your login.
- The MissionFish service is not directed to children and children are not eligible to use them. We do not collect or maintain Personal Information from people we actually know are under 18 and no part of our service is designed to attract people under 18. If we learn later that a user is under 18 we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilising the service.

3. Necessary Disclosure
- Donors who make use of the eBay for Charity programme accept that we may need to:
- Disclose their Personal Information when claiming Gift Aid from H.M. Customs & Revenue.
- Share their Personal Information with Points of Light Foundation US, under a contractual agreement and the Safe Harbour Programme (http://www.export.gov/safeharbor
) that ensures privacy for your Data to a level as that required under UK law so as to process the donation;
- The MissionFish service is not directed to children and children are not eligible to use them. We do not collect or maintain Personal Information from people we actually know are under 18 and no part of our service is designed to attract people under 18. If we learn later that a user is under 18 we will take steps to remove that user's Personal Information from our databases and to prevent the user from utilising the service.

4. Optional Communications
- When donors make use of the eBay for Charity programme they can tell eBay whether they want to receive Optional Communications from the charities they support.
- We receive contact information about donors who have opt in through eBay to receive communications from the charities they support. These details are made available by us to the Participating Charities in their MissionFish Accounts. The use of these details by the Participating Charities is subject to our Charity User Agreement.
- Our Charity User Agreement states that Participating Charities must at all times comply with the Data Protection Act 1998 (DPA) and the Privacy and Electronic Communications (EC Directive) Regulations 2003 (and any re-enactment or replacement of or amendment or extension to such legislation) and any other applicable law or regulation relating to the protection of Personal Data (as defined in the DPA). We also undertake to comply with all relevant legislation.
- Donors may change their communication preferences by amending them within their eBay accounts.

5. Disclosure of Personal Information to Third Parties
- We only give information to third parties in order to provide our services or when legally obliged to do so. We require our Third Party Service Providers to promise not to use such Personal Information except as necessary to provide the relevant services to us. We cannot maintain responsibility for the manner in which third parties use or further disclose the Personal Information collected from you after we have disclosed that information to them. We bear no responsibility for not exercising control over Third Party Service Providers' use or disclosure of Personal Information provided by you in connection with your use of the MissionFish service.

6. Security Measures
- The Website has security measures to protect against the loss of use and unauthorised alteration of Personal Information in our control. For example, whenever the Service requests that Authorised Users provide sensitive information, that information is encrypted with industry standard encryption techniques. When you are viewing a secure page within the Website a locked padlock icon will appear at the bottom of web browsers such as Microsoft Internet Explorer. . Credit card authorisation requests are sent using the same encryption technology. Furthermore, access to Personal Information is physically restricted within MissionFish's own offices, so that only certain MissionFish employees are granted access to such information as appropriate to perform specific jobs and tasks (e.g., performing customer service). Some information is also stored in an encrypted form within MissionFish's own databases.
- Please be aware that, although we endeavour to provide reasonable security for information in our possession and control, no security system can prevent against all potential security breaches, and MissionFish bears no liability for uses or disclosures of Personal Information or Non-Personal Data arising in connection with the theft thereof. Likewise, Authorised Users are responsible for safeguarding the confidentiality of passwords to the Website and Online Tools, and MissionFish bears no liability for access to, or use or disclosure of, Personal Information, if such access, use or disclosure arises in connection with the theft or disclosure (whether intentional or negligent) of such Authorised User's password.

7. Changes to this Policy
- If we change our privacy policy, we will post those changes on the Website so that users are always aware of what information we collect, how we use it, and under what circumstances, if any, we will disclose it. Any such posted changes will be effective upon the date indicated by the posting, but in any event not sooner than 7 days after posting. However we will continue to treat previously collected Personal Information in accordance with the privacy policy under which that information was collected, unless we obtain your permission otherwise.

- If you recommend a friend or a charitable organisation to us we may attempt to contact those contacts through a one time email in order to invite them to visit the Website and we will identify you by name as having made the recommendation.
